1. Can You Drive Without An MOT?

You cannot drive your vehicle on the road if the MOT has expired, unless you have booked an MOT and are driving your vehicle to the test centre.

You will need to be able to prove the appointment if stopped by the Police and could be prosecuted if caught driving without an MOT or test appointment.

Not sure.

It's not legal to drive anywhere but to a booked MOT appointment. The appointment would also need to be that day not in a weeks time, that's what I've always believed.

Car is stuck, I'm scratching my head a bit.

You can book an MOT via the specialist on the day you drive it to them even if they then cancel the MOT and subsequently do the work later before retesting. That way it's all above board: there is a booked MOT which you are driving it to!

Toni - as mentioned you can drive to and from a booked MOT.
I use to drive to Rons at RK TUNING who is in Essex from Surrey for my booked MOT & associate work - no problems. On the one time I was stopped for something else I explained the car had to go to a specialist & not just any normal garage.

That's helpful thanks Speedy.

I might try and get it to Exclusive Tuning, think they are in Hertfordshire as well. Anybody got a number for them?

If you don't live too far from Welwyn Garden City try Car Solutions, Peter Gordon 01707 335236. He does all my cars and has all the latest diagnostic gear and is very good.
Explain your situation and I'm sure he will organise an MOT in the area. He also does Terraclean which I've had done to all mine.

Bit of a caveat on this predicament.

A vehicle CAN be driven to a Pre Arranged MOT appointment if it is taxed, however if its not taxed due to expiration or is SORN then legally it should be transported to MOT and not driven.
Bit of a f*cker this one as its a catch 22, you can't tax a car without an MOT

Its not documented on Dvla website - it only states about pre arranged MOT appointments, so some argue its a bit of a loophole, but in short, if it aint taxed, prebooked appointment or not, it shouldn't be driven to an MOT, and if VOSA catch you, be prepared to be bent over.

Worst case scenario also includes being bummed for no valid insurance as insurance is only valid on a vehicle with an MOT, if your involved in an accident travelling to the MOT station, your not covered.

Not true as case law has overturned. An exception is made if you are caught driving without tax on the way to a pre-booked MOT. However it is not guaranteed in certain situations – ie. were you speeding or committing another offence.

Road Tax aside if you are driving without an MOT it is a criminal offence, unless you are driving to a pre-booked MOT test at an approved centre, or you are driving to an appointment at a garage to have any necessary work carried out after the vehicle has failed an MOT test.

Speed Merchant, believe me, I tried to get written confirmation on what the situation was with driving a car with no Tax to a prebooked MOT appointment straight from the horses mouth, they wouldn't, like you said, no guarantee's and I can only assume its hard to find a documented answer to the driving to an MOT appointment with no Tax for a reason, but rule of thumb is, if it aint taxed or is SORN, its damn risky taking it to an MOT appointment, and as we all know, all it takes is that one ar$ehole copper to make life difficult and have the car taken away for you to then have the headache paying to get the car back and challenge the constables decision and then have to claim the money back.

I mean no disrespect at all buddy, and I'm really not being an argumentative Son of a B!tch, but i'd personally advise to eb on the side of caution unless you're prepared to fight your lawful rights to travel over legal statutes and legislation that many members of the constabulary conveniently forget they didn't swear an oath to uphold

Apologies for the slight off topic and if I come across like a bit of an ar$e, but not everyone is willing to fight there corner and prefer to live a quiet life, in those instances its easier to get the car transported (or use Trade Plates if you have them)

For the record, I took both my cars to an MOT appointment with no Tax

I do remember reading a case some years ago about a chap who was caught bang to rights with no licence or insurance and was over the drink drive limit, but got off scott free at Crown Court as he was 'travelling' and not 'driving'

Dunno 'bout you guys, but how often do you see a cops car? And when you do they're quite often on a mission.
To consider transporting your car seems to be a bit over the top. As long as the MOT is booked with the prior work to be done, would have to be a real NBOW cop to make something out of that, and TBH I don't think he could. I think you can retrospectively tax your car up to a month.
What's the expression, "Rules are made for the obedience of fools and guidance of wise men" (Douglas Bader).

Well that adds to the predicament as the car is currently SORN, but I can't tax it without the MOT!

It stands to reason your car would be SORN without tax and MOT so....

Do you reckon its the suspension that has lowered the car then?
Were you running different set up before?

Jags, that is brilliant!

What I can't understand is why when I contacted them about this no one could confirm this

I really am not sure, but I haven't changed anything yet I swear it's lower than it was!

Yay! Got my MOT today. What a relief. It failed on emissions so I got hold of an HKS cat, apparently it was still a bit of a struggle but we got there.

Now I need to review the suspension issue. I think I am going to change it, just what to is the issue.

Nismo S Tune HA's, I was very pleased with them on my Nur. No noise, height adjustable (if you get the HA's) and great performance. Mine came with the non height adjustable S-tunes but they were too low, so I fitted Teins on it but they were shit by comparison fortunately Nismo then brought out the HA's.

HKS Hipermax II onwards are also very good (On my old Supra anyway).
