While doing an oil change on the BNR34 I noticed a leak next to the gearbox. The leak comes from the shifter lever (see picture of boot). Obviously the boot has a crack and oil leaks through it.
I'm going to change the boot.
However is it expected to have oil (from the transfer case) going back as high ? (circled in red on second picture)

Its normal mate. Replace the boot and you should be fine. On a sidenote I think the N1 cars has a baffle on the shifter housing to prevent oil from spilling up there, but unless you fancy autobahn or heavy duty circuit racing I think you should be fine.

You're right. On R32 and R33 Nismo developed a oil baffle plate to avoid that problem (part 32150-RS590). The baffle plate was integrated on the R34 as standard.
Oil level is ok. I don't see how I could fill the transfer case above max level using the filling plug in fact.
