Hi,
Guys, I have a question for all of you who are from Germany.
Is there any law in Germany that says that a brand new car cannot be sold to a non German and non EU citizen and exported out of Germany/EU as a brand new car.
Does it obligatory first have to be registered to some other company in Germany and then sold/exported as a second hand car?
This is VERY important to me, it is about canceling my order...
Please answer that it can be done without registering the car in Germany... ;) :nervous::nervous::sadwavey:

As far as I know, there is no such law. But I'm not into the new cars business. I can't really see why there would be a problem, maybe you could claim back the tax also..

I will get the German tax back either way. I have to pay taxes and customs when I import in to my country! OK I am glad to hear that you think there is no such law... ;) better than the first answer was - YES, everybody knows that new cars cannot be exported from Germany...
But let's wait for someone who is more sure...

I bought 2 cars at a dealership that has a really high export rate. I could ask them, if nobody comes up with a definite answer.

Just spoke to my HPC....if you want to buy it new then you can do that.....its your choice,not the choice of the HPC.

They try to get the cars registered as maybe they get some more €´s for sold GTR´s with reg. then without registration...:chuckle:

SuzaFan there is no such law in Germany. Only thing you really have to be carefull about are customs in Germany. If you are paying the price with MWST, then you have to get the brutto invoice and a EX-1 (export) document. You have to ask the HPC where to go to the customs in his town. Since the goods are worth more then 5k EUR you have to show them (customs) the car and get a few stamps from them to be able to move on to Croatia, and leave them to have a copy of this document. When leaving the EU in Slovenia you will get another stamp on the EX-a document that clears that you exported the goods from EU. When you get this EX-1 back to your HPC he will pay you the MWST back. Its very important that you visit the customs in Germany, without this 1st Stamp you will be refused while trying to get the 2nd one.

Registering the car, and having it on German plates for some time, and then importing it to Croatia would only make sense if you would be charged with less taxes importing it (which is possible since it would become a used car). For this to be an option, this car would have to be 1st registered to a firm, if its registered to a person you lose the possibility to get the MWSt out of it.

Tranq, I found out yesterday that the law has changed here (in August 2009.) - The car that was registered even only 1 day in Germany becomes a used car (till August 2009. all cars till 1 year old were treated as new cars) - the taxes and customs and everything that you have to pay to the government are MUCH HIGHER on used cars and become so high that I would have to cancel the order...
As I understand now, the HPC definitely can sell me the brand new car, without registering it to some other company before! That's exactly what I need!
I am calling them immediately!

Don't forget to get a "Red" Export Number Plate :) Ask the HPC about it, they should know about them!

Alex, can you tell me which is your HPC?

For the export number plates, I know for them, they are called "zoll plates"...
I contacted my HPC, they are making my life complicated, they still didn't confirm that they can sell my car without registering it to another company... the "GTR specialist" who I was dealing with is on vacation, and the person who is doing his job now is telling me that "he doesn't know what I arranged with Herr who is on vacation now and that I should wait till September 21st when he comes back"
Can you believe that?
I got mad and sent him an e mail that I am sure that he can find out if the HPC can sell me the car as new and if cannot find that out or doesn't want to, to give the contac of his boss or someone who can to that!
Could it be possible, if my HPC doesn't want to sell me the car as new, to transport it to another HPC that wants to do that...?

Seems like you are in a similar situation to me (I am in Gibraltar) The dealers in the UK seem reluctant to sell a non registered VAT free car. For Gibraltar import it must be new and unregistered to get a lower import duty. You might find Nissan Germany, like Nissan UK do not want unregistered cars going overseas.

Well, it could make sense for buying cars overseas that you can buy in your own country...
But I don't have HPC in my country and I cannot by GTR in my country, I have to import it from somewhere...
THough, I am getting kinda positive answers from them, put some pressure on them today and they are saying that it can be done the way I want it, they will confirm it officially next week...
Some HPCs want to do it immeditaely and some are probably afraid of Nissan Europe...But when I ordered the car, Nissan central had my data, address and everything and if they really didn't want to sell me the car, they would have seen that and not invite me to the Race Academy last year ;)
I think I'll get it solved!

They also have my correct (Croatian) address and there have been no complaints so... I can't imagine they would complain when they have no official channel in the country - to get one, you must import it, there is no other way.
