According to this thread on NAGTROC: NISSAN SETTLED CLASS ACTION CLAIM! - NAGTROC - The Nissan GT-R Owners Club

Summary is that gearbox failures that occurred during LC1 (the original 4,500rpm launch control available on early USDM and JDM cars) will be covered under warranty, provided all owners now upgrade to LC2 (what we have).

Of most potential interest to us EDM owners, is that Nissan North America have agreed that turning VDC off only invalidates the warranty for the period where it is switched off and if a failure occurs after turning it back on, Nissan will have to prove it was due to VDC having been off earlier (which would be nigh-on impossible IMO).

Overall, good news!

No

Intel gets sued in the European Union law but not in the US. That said for things like this there is lot less chance in the EU, we litigate less here

EU cars have the "we are not allowed the disable the vdc-function...."

Nissan have written on their 2008/2009 speclist that we have the chance to disable the VDC... off = Driver doesn´t want the help of the system....was written on the website....

im sure most of the senceless bu*****t written in our manuals/warranty books is against our EU law:wavey:
